Terms & Conditions
Overview:Dimmi provides users with the ability
to make reservations at participating restaurants by directly
synchronising with restaurants' reservation systems (Service). Once
a booking has been confirmed, Dimmi will issue you with an e-mail
& booking confirmation number to confirm the booking. By using
Dimmi, you agree to receive electronic communications from Dimmi
and our associated restaurants, affiliates, partners and third
party suppliers (Affiliates) in relation to your bookings.
Payment:Dimmi does not charge you a booking fee.
You simply pay the restaurant for your meal after you have dined in
the restaurant.
Booking Confirmation Number:You will receive a
booking confirmation number via e-mail once your booking has been
confirmed and accepted by the restaurant. Please ensure to use this
number in all communications with Dimmi or the restaurant.
Arrival Identification:You will receive an
immediate confirmation e-mail & a reminder e-mail 24 hours
before your booking. Please ensure to present either of these
e-mails to the restaurant host at the time of arrival, otherwise
you may be identified as a "no-show" and subsequently suspended or
banned from using the Service again.
Changes:To make changes to the date, time or
number of diners, please contact the restaurant directly at least 2
hours in advance of the scheduled meal period and quote the booking
confirmation number. Changes will be subject to the restaurant's
availability.
Cancellations:If you wish to cancel your
reservation please contact the restaurant directly at least 24
hours in advance of the scheduled meal period. For group bookings
of six (6) plus, please ensure to provide at least 48 hours' notice
of any planned cancellations. The restaurant's contact details can
be found in your confirmation e-mail.
No Shows:Failure to attend the restaurant at the
reserved time will result in you being identified as a "no-show."
We may choose to restrict, suspend or terminate your access to the
Service if you are identified as being a "no-show" on more than
three (3) occasions over a 12 month period.
Late Arrivals:Please arrive at least 10 minutes
in advance of the scheduled reservation time. The restaurant
reserves the right to cancel your booking and allocate your table
to other guests if you have not arrived within 15 minutes of the
scheduled seating time (ie. 15 minutes late.)
Meal Durations:The restaurant reserves the right
to require you to vacate your table after a fair period of
time.
Privacy Policy:We will collect, use and disclose
your personal information in accordance with our Privacy
Policy. In addition, your use of the Service may be
subject to Affiliates' privacy policies, including if you access
the Service via an Affiliate's website, mobile site, application or
other portal (Access Services).
Personal Information:To use the Service you are
required to provide certain information, including your name,
telephone number & e-mail address. You must ensure that all the
information that you provide to us is true and accurate. In
particular, you must ensure that the e-mail address you provide is
accurate to ensure you receive important communications from us and
our Affiliates regarding your bookings.
E-mail Communications: You will receive e-mails
& / or other communications related to the fulfilment of your
booking and other service information and we may use your personal
information for that purpose in accordance with our Privacy Policy.
In addition, you may receive periodic marketing and promotional
e-mails from Dimmi or our Affiliates if you did not opt-out of
receiving such communications at the time of booking or using the
Affiliate's website or services. If you would rather not receive
such marketing and promotional e-mail communications from us or our
Affiliates, you can unsubscribe by following the instructions in
the sender's e-mail communications. You acknowledge and agree,
however, that you will still receive service communications
specifically relating to the Service which you cannot unsubscribe
from (such as booking confirmation e-mails).
Booking Guarantee:In the event that you make a
booking through Dimmi, but the restaurant loses, misplaces or
simply cannot accommodate the booking through direct fault of its
own, then the restaurant agrees to provide you with a complimentary
meal for two (to the maximum value of AU$50.00.) This only applies
in instances when the booking cannot be honoured. This does not
include situations when the restaurant does not have record of your
booking but is still able to accommodate you. Requests should be
put in writing to guarantee@dimmi.com.au.
Dimmi and its Affiliates will not give any refunds or offer any
form of credit or discount (including complimentary meals) to users
regarding bookings that are not honoured by the restaurant or if
you are otherwise unhappy with the meal or service offered by the
restaurant.
Additional Affiliate Conditions:In addition to
these Booking Conditions, the use of associated Affiliate websites,
mobile sites, applications, products and services may be subject to
additional terms and conditions with which you must comply when
using the Service. Those terms and conditions will be in addition
to these Booking Conditions, not a replacement of.
Service Termination:We have the right to
terminate, restrict or suspend your access to any or all of the
Service if we or our Affiliates believe that you are misusing the
Service or if you breach these Booking Conditions. Our
Affiliates may also have the right to terminate, restrict or
suspend (i) your access to any or all of the Service that is
accessed via their Access Service(s), or (ii) your Access
Service(s), if you breach the terms of use of the applicable Access
Service(s).
Liability Limitations: You have certain rights,
such as consumer guarantees, under law which cannot be
excluded. To the maximum extent allowed by applicable
law, Dimmi and its Affiliates shall not be liable for loss or
damage of any kind arising from the use of the Service (including
if the Service is accessed via the Access Services), including, but
not limited to, any loss, claim, action, demand, damage, or any
special, exemplary, punitive, incidental, or consequential loss or
damage, of any kind, whether based in contract, tort or otherwise.
Neither Dimmi not its Affiliates is an agent of or connected with
any affiliated restaurant with which a user has made a reservation,
aside from the Service provided through Dimmi. To the maximum
extent allowed by applicable law, Dimmi and its Affiliates exclude
all liability and responsibility arising from any content available
from the Service, including any reliance placed on such content.
You bear the entire risk of the completeness, accuracy or
usefulness of any content accessed from the Service. Please
see our Review Guidelines for further information about
Postings published on the Service.
